We may, at our sole discretion, amend the terms and conditions of use of this agreement by publishing the revised terms on Alexa`s website. If any of these conditions are considered invalid, null or unenforceable for any reason, this condition is deemed dissociable and does not affect the validity and applicability of a residual condition. Part of the Card API is provided by HERE North America, LLC or its affiliates (“HERE”) and your use of the card API is subject to the terms and conditions of HERE Materials, available in developer.here.com/terms-conditions (the “HERE”). If you access the Map API or use it (including via Amazon Maps` Deviation), you agree to HERE`s terms and you must comply with them (in addition to the terms of the agreement), and HERE and its related companies are the third-party beneficiaries of this agreement to not enforce HERE`s terms against you. Making the card API available to you is a “separate offer” within the meaning of HERE conditions. It is only with regard to the application of HERE conditions by HERE in conjunction with the Card API that HERE conditions apply in the event of a conflict between the HERE terms and the present agreement.
Any dispute or claim that relates in one way or another to the agreement (including Alexa`s declaration of confidentiality) or your use of services (including the Toolbar Service) will be settled through mandatory arbitration and not in court, except that you can file claims in a small claims court if your claims are justified. This agreement is governed by the Federal Arbitration and Federal Arbitration Act. Fees and payment. You pay us the fees and fees associated with the use of time materials in time campaigns (“Fee”), as agreed on our development portal or between you and us. For some moments campaigns, you can specify the dollar amount you pay for each end-user share you set (that stock, “stock” and dollar amount, “cost per share”), and you`ll be charged up to the cost per share for each end user doing the action and for which we provide you with a reward code (as defined below).
